Does HTC violate Apple patents because Android founder Andy Rubin was inspired by them when he worked at Apple?

Long title, longer legal filing, but the gist is Apple seems to be claiming Android founder Andy Rubin was working for Apple and reporting to the man who filed for a patent on Apple’s behalf that Apple is now suing HTC for violating in their Android phones. Even longer:

Android and Mr. Rubin’s relevant background does not start, as HTC would like the Commission to believe, with his work at General Magic or Danger in the mid-1990s. In reality, as the evidence revealed at the hearing, Mr. Rubin began his career at Apple in the early 1990s and worked as a low-level engineer specifically reporting to the inventors of the ’263 [realtime API] patent at the exact time their invention was being conceived and developed. [...] It is thus no wonder that the infringing Android platform used the claimed subsystem approach of the ’263 patent that allows for flexibility of design and enables the platform to be “highly customizable and expandable” as HTC touts. [...] While Mr. Rubin’s inspiration for the Android framework may not be directly relevant to the pending petitions for review, that HTC felt compelled to distort this history is illustrative of the liberties it takes in attacking the ALJ’s [initial determination] and the substantial evidence supporting the ALJ’s findings.

FOSS Patents Florian Mueler says that since Rubin works for Google, not HTC, this would be far more meaningful if Apple eventually sues Google directly, or if/when Google’s Motorola purchase goes through.

Google (or a Google subsidiary like [Motorola Mobility) would almost certainly be found to infringe the relevant patent intentionally, and willful infringement would greatly increase Apple's chances of obtaining an injunction as well as triple damages.

Mueler also points out Rubin and co. may have willfully infringed Oracle (formerly Sun) Java patents in Android as well.

Regardless of where you fall on the whole Apple vs. Android and patent system issues, right now it's just more fuel for the legal soap opera. Would Google throw Rubin under the bus on this?

About seven minutes into The Plan®, I realized I was not going to be getting any sleep, primarily because I would not be able to relax enough to make it restful. As a last resort, I turned to the App Store. In it, I found an app simply called Blackout Alarm. You turn the app on, plug your iPhone in, and if at any point your phone detects that it’s running off of the battery, it blares an alarm. That’s it! I plugged the phone in, turned it on and tested it a few times by pulling the plug out of the dock. Eureka! Something so simple, yet so perfectly tailored to my exact need at that exact moment, and more importantly, singularly providing me a sense of comfort that I didn’t expect to get at all that night.

What Case Makers Say About the iPhone 5

There have been tons of rumors lately regarding the new additions Apple will be adding to the iPhone 5, expected to be announced later this month. Since Apple missed their annual announcement for the iPhone, which should have officially happened this Summer, people are expecting a huge overhaul to the most popular smartphone on the market. Case makers have their take on what the rumored next-generation iPhone will be like. See below for more.

Usually, case makers are the first to predict what next iterations of the iPhone will look like, of course after the initial mockups and such. Italian iOS blog, onclick="javascript:pageTracker._trackPageview('/outgoing/www.macitynet.it/immagini/test/iphone5cover/index.shtml');" target="_blank" href="http://www.macitynet.it/immagini/test/iphone5cover/index.shtml">Macity.net has got their hands on a few cases from a case manufacturer that could depict what the iPhone 5 will look like come later this month.

Although the cases aren’t quite completely genuine, they could just be what the iPhone will look like. If true, then the iPhone 5 will in fact be slimmer, much like the current iPod Touch 4th generation, as well as have a larger display. The latter apparently seems to be the most appealing to most of our readers, evident from the results of our ongoing href="http://www.iphonealley.com/news/will-you-still-buy-iphone-5-if-its-a-small-upgrade">poll. Did Apple Impersonate Officers To Search For iPhone 5 Prototype?

Earlier we reported on stories that Apple hadhref="http://www.everythingicafe.com/did-apple-lose-an-iphone-5-prototype-at-a-bar/2011/09/01/"> lost an iPhone 5 prototype and had gone with police to go try and find it at a residence — a move that the href="http://www.everythingicafe.com/sfpd-claims-to-know-nothing-of-lost-iphone-5/2011/09/02/">San Francisco Police Department claims to know nothing about.

Now the story has taken an ever stranger turn as the href="http://blogs.sfweekly.com/thesnitch/2011/09/lost_iphone_5_apple.php">SFWeekly is reporting that Apple security specialists impersonated police officers during the search. They talked to the man whose house was searched, who is claiming that six people came to his house at 6pm, and claimed to be “with the SFPD”, and flashed badges. He says they threatened his family with deportation even though all are American citizens, and then offered him $300 for the phone. He consented to them searching his house and car.

One left his phone number, a number belonging to Anthony Colon, Apple employee and senior investigator. His LinkedIn and Facebook information have since been cleared out, but people were able to grab screen captures.

This has put a remarkably dark spin on the events, impersonating officers is not something that is to be taken lightly. Has Apple gone too far with this? I have trouble believing that they thought this wouldn’t get out into the press.

Amazon’s iPad competitor is a 7-inch Android-forking Kindle tablet… for $250?

M.G. Siegler from TechCrunch claims he’s gone hands-on with the future of iPad competition, and the future of Amazon’s Kindle line — a 7-inch full color, touchscreen tablet built on an Android core but entirely Amazon at the interface level. All for $250. If you think it sounds like the Nook Color, you’re not wrong, it just trades the B&N brick-and-mortar shelves for Amazon’s hugely popular homepage.

The interface is all Amazon and Kindle. It’s black, dark blue, and a bunch of orange. The main screen is a carousel that looks like Cover Flow in iTunes which displays all the content you have on the device. This includes books, apps, movies, etc. Below the main carousel is a dock to pin your favorite items in one easy-to-access place. When you turn the device horizontally, the dock disappears below the fold. [...] But the key for Amazon is just how deeply integrated all of their services are. Amazon’s content store is always just one click away. The book reader is a Kindle app (which looks similar to how it does on Android and iOS now). The music player is Amazon’s Cloud Player. The movie player is Amazon’s Instant Video player. The app store is Amazon’s Android Appstore.

With nary a Google app in sight. Phil Nickinson from Android Central says:

It’ll still be interesting to see how a post-Nook Color Amazon tablet will compete. The Kindle’s no longer the only game in town, and Barnes & Noble has a pretty good leg up by being a brick-and-mortar organization as well, plus it’s got its excellent in-store customer training, which has to take a lot of the scare factor out of using the Nook. (One could argue that a proper tablet UI doesn’t need any sort of training, but we digress.)

Everyone and their comment thread seems to be thinking this will be the first real competition to iPad (which is what they said about Xoom, PlayBook, TouchPad… you get the idea.) It well might. It’ll be small. It’ll be light. Amazon has a great checkout system and a compelling content story in the US (international is, as with every platform, a mixed bag of hurt.) Their hardware has never been great, however, and international sales have become increasingly important to Apple and iPad.

People like cheap, but cost and value aren’t always the same thing — as Apple has proven time and again. (Apple’s competition hasn’t, however, so maybe they’ll be in even more danger from the KindleDroid?)

One thing is for certain — Android is the new Linux.

    Starz wanted Netflix to charge more for “premium tier”

    Netflix couldn’t come to a deal to keep Starz content on their service, so they’ll be losing it next February, but it turns out Starz wanted more than just Netflix’s money to stay — they wanted more of our money too:

    Netflix offered Starz more than $300 million per year to renew their agreement, but the pay cable channel was insistent on so-called tiered pricing, according to people close to the negotiations but not authorized to speak on the record. Tiered pricing would require Netflix subscribers who want movies and television shows from Starz and other premium providers to pay more than the standard $8 per month.

    Basically, they wanted Netflix to become as expensive as cable so we, the customers are discouraged from leaving cable and living off digital antennas and services like Netflix.

    That’s nice for Starz, but do you want to pay more for Netflix to keep The Karate Kid on your iPhone, iPod touch, iPad, and Apple TV?

    iPhone 5 To Be Wider, Thinner, Curvier?

In a gallery on their website, they not only show how the case compares to the iPhone 4, but also to an iPod Touch.

    style="text-align: left;">Assuming this case is correct (that’s a big assumption), the iPhone 5 looks to have a curved back like the iPod Touch, and be substantially taller and wider than the iPhone 4, but also noticeably thinner. The volume controls and lock switch are now on opposite sides of the body, and most interestingly the dock connector seems to be wider. I’m hoping this last point is just an artifact of case manufacturing, and not indicative of a change in dock cable.

    Doodle Jump Finally Hits iPad

    SFPD Claims To Know Nothing Of Lost iPhone 5

    Yesterday href="http://www.everythingicafe.com/did-apple-lose-an-iphone-5-prototype-at-a-bar/2011/09/01/">we reported on a CNET article that claimed Apple had lost an iPhone 5 prototype at a bar in San Francisco, which oddly mirrored last years leak. As part of that we linked to a CultofMac report which indicated the bar owner had no idea this happened, but it looks like the San Francisco PD are also in the dark — or else keeping mum.

    Both href="http://blogs.sfweekly.com/thesnitch/2011/09/sfpd_iphone_5.php">SFWeekly and href="http://www.pcmag.com/article2/0,2817,2392295,00.asp">PCMag have been talking to San Francisco’s finest, and the police officers seem to have no idea that this happened, nor if there was an investigation.

    PCMag spoke with two spokesmen for the San Francisco Police Department, Michael Andraychak and Troy Dangerfield, and neither had any knowledge of the incident, even after they had made several internal queries. Dangerfield also said the SFPD had been on the phone with Apple Global Security for 30 minutes this morning trying to figure out if there was an incident and that Apple was “not giving us anything” and that they were “getting the round around [sic].” Dangerfield said that all the police would need is a name of a victim (presumably the employee who lost it) to perform an adequate search in police records for the incident.

    What’s so bizarre about this is that the original report cited Apple and the police attempting to track down the phone together.

    It seems bizarre that so few people know if this was a legitimate case or not. We’ll be sure to keep an eye on this one.

    AT&T May Give Up 25% Of T-Mobile To Keep Merger

    Not guilty plea from those accused over iPhone 4 prototype lost in bar case

    The two men accused of theft of an iPhone 4 prototype last year have pleaded not guilty to the charges. The iPhone 4 in question was left in a bar by Apple employee Robert Gray Powell in Redwood City, California. The two men, Brian Hogan (pictured above) and Robert Sage Wallover will face charges of midemeanors rather than felonies.

    Gizmodo subsequently bought the iPhone 4 prototype from the two men and the rest as they say is history. No charges were ever filed against Gizmodo however, under California law, any person that finds lost property and is aware who the owner is likely to be and “appropriates such property for his own use”, is guilty of theft. Also any person who knowingly receives property that has been received illegally can face prison for up to one year.

    Anyone have strong feelings one way or the other how this one will end up?

    Many of the rumors that we have almost come to take as fact regarding iPhone 5 are beginning to be contradicted, with separate rumors negating features such as a bigger screen or new design.

    What we know for sure about the iPhone launching in fall is that it will have a new name, be it 4S, 5, or iPhone uBuy. The only change 100% a given if it were to exist at all would be the A4 chip being replaced by an A5 or A6 sporting a speedier dual-core processor and a superior graphics chip. Better performance could be enough for some to make the upgrade, right? Mac systems can go a few revisions without cosmetic changes, strictly superior hardware. To be fair, competition is too fierce in the mobile market for that to be the only change after 15 months.

    Other than how it is 99% likely that a launch will happen simultaneously on both AT&T and Verizon, every other detail about iPhone 5 can be argued, rebuked, and speculated about for hours on end. Hey, that’s just one of the reasons why iPhone Alley exists. iPhone 4′s successor could simply be faster, or it could be entirely different with a new design, bigger screen, and a built-in chocolate fountain.

    More recent reports are saying that the next iPhone we see will be an insignificant, disappointing revision. After the long ******* (what? I just like using asterisks) wait, we better get a big game-changer. After all, iPhone 5 could be a great upgrade if all of the previous reports turn out to be true and there are still a few surprises left.

    If the next iPhone is a small upgrade will you still be compelled to purchase it? If only to own the latest-and-greatest in Apple’s phone lineup. What will it take to get you to rush out to a store on launch day?
