Apple closed as the most valuable company in the world

Apple closed as the most valuable company in the world

While yesterday Apple only briefly passed Exxon to become the most valuable company in the world for a few minutes, today they managed to close that way. Whether they close that way tomorrow or not doesn’t matter. Whether they continue to rack up these type of accomplishments or go on to yet again eclipse them, whether they continue to lay, an image of the splendor of Silicon Valley in glory undimmed before the introduction of the microprocessor, doesn’t matter.

Today, Apple closed as the most valuable company in the world, by market cap.

And iPhone 5 hasn’t even been announced yet.

What on earth is next?

Daily Tip: How to jailbreak iOS 5 beta 5 via RedSn0w 0.9.8b5

If you’re currently running iOS 5 beta 5 but just can’t live without your jailbreak, the Dev Team has already released RedSn0w beta 5. The only catch is, it’s tethered, just like the previous beta versions of RedSn0w for iOS 5.

Be advised that not all jailbreak apps and tweaks have been updated to support iOS 5. If you’re alright with running tethered and don’t mind a few bugs here and there, follow along for a quick walkthrough.

By this point, almost anyone jailbreaking is already familiar with RedSn0w and how it works. It’s no different this time.

And I can’t say this enough times, if your device is not listed above, please do not attempt to jailbreak it on iOS 5!

After you have iOS 5 beta 5 installed on your device and your version of iTunes upgraded to 10.5 beta 5, follow the steps below to jailbreak.

  1. First launch RedSn0w.

  2. It should ask you to navigate to a firmware file. Simply navigate to the iOS 5 beta 5 firmware file instead of beta 2.

  3. Once you click next, RedSn0w will take a minute to do it’s thing. You should see a patching kernel message and that Redsn0w successfully recognized your firmware.

  4. Next select the options you’d like RedSn0w to perform. I typically only select Install Cydia. It’s worth noting that this is where you will perform a tethered boot if needed as well. You will just select Just boot tethered for now if you need to do this or your device reboots or dies.

  5. Redsn0w will now walk you through putting your device into DFU mode

  6. After you’re successfully in DFU mode, simply let Redsn0w do its thing and you’re done!

That’s it! The process is pretty much the same as the first time around. But if you do run into problems or have questions, make sure you check out our TiPb Jailbreak Forums. We’ve got tons of great members more than ready and willing to help!

Tips of the day will range from beginner-level 101 to advanced-level ninjary. If you already know this tip, keep the link handy as a quick way to help a friend. Chat for GTalk now available

Chat for GTalk is a Google Talk client for the iPhone. The appearance is highly customizable and comes with three themes.

I’m not a big Google Talk user, but if I was, the UI and themes for this app would suck me in.

Chat for Gtalk offers a unique ability to completely change the appearance of chat window, contact list, fonts and background colors of the app. The first version of Chat for Gtalk introduces three fancy themes: Paper, Racing and Simple White.

Amazon and Walmart Sidestep Apple’s App Store Guidelines

Apple’s revised app store restrictions have not been popular with third party developers, publishers and other companies. Many have been figuring out new ways to deliver their content on iOS devices while avoiding giving Apple a cut of their profits. On Wednesday, both Amazon and Walmart launched web-based services that sidestep Apple’s App Store.

Amazon released a web-based app called Kindle Cloud Reader for Kindle owners to access their digital libraries on their computers or other mobile devices. The Cloud Reader syncs all your Kindle books and magazines so you can start reading on your computer, and pick up where you left off on your onclick="javascript:pageTracker._trackPageview('/outgoing/www.ipadngravy.com');" target="_blank" title="iPad" href="http://www.ipadngravy.com">iPad. Early reviews seem positive, but there have been reports of a few glitches, and some are not happy that it can only be used with Safari or Chrome.

Walmart also launched their Vudu web streaming app on Wednesday. The new service allows users to rent or buy over 20,000 movies and watch them online. There is a Vudu icon for the iPad home screen that redirects you to the Vudu website where you can access Walmart’s library. Just like Netflix, Vudu also allows you to stream content through other devices like the PlayStation 3. Rental rates are around $4 to $6 dollars.

In July, onclick="javascript:pageTracker._trackPageview('/outgoing/www.theipadguide.com/content/onswipe-helps-publishers-get-around-app-store/7178371');" target="_blank" href="http://www.theipadguide.com/content/onswipe-helps-publishers-get-around-app-store/7178371">Onswipe helped magazines like Marie Claire create tablet-friendly versions of their websites to avoid having to create apps for tablets.

Apple having issues with LGD panels used in iPad 2?

LGD, the leading supplier of LCD panels, appears to be having some manufacturing issues when it comes to the 9.7″ LCD panels that are used in the iPad 2. After receiving several defective units, Apple has reportedly pulled them until the issue can be sorted out.

LGD fell 1 million units short of their projected estimate of panel shipments. These defective units could have a lot to do with that. It will no doubt continue affecting them until the issue is resolved.

In the mean time, Apple will continue using Samsung and CMI for iPad 2 LCD panels. Apple has also had their issues with Samsung as well. But if you’re in a tight spot, I guess you do what you need to in order to meet demand in the mean time. Digitimes’ source seemed certain that LGD would remain the top panel supplier if the issue was rectified.

Readdle Card Scanner Pro Review

Readdle is back with another app perfectly suited for business and professional users. Have you ever lost an important business card? Or were given too many to count in a day containing information about contacts you need to follow up with? If the answer is “yes” to either of those questions then the new Card Scanner Pro app can make your life a little easier and more organized when it comes to the oh-so-important business cards.

In as few taps as it would take to take a picture of a business card, Card Scanner Pro can analyze all/most of the information on the card and assist a user in saving a contact with it. First, a user takes a picture of a typical business card or utilizes one already saved in the camera roll. Next, Card Scanner Pro presents a nice animation to indicate that it is being scanned. Finally, details on the card (such as name, address, phone number, and email) are put in their respective forms in plain text. A full-fledged contact can be created in under a minute then the business card can be disregarded.

Card Scanner Pro does an admirable job of analyzing business cards, but text recognition is about 90% accurate. Even with a perfectly clear photo, I found that many forms were filled out with the correct information but missing letters or containing typos. However it is easy to proofread the work done since tapping on information will show users exactly where Card Scanner Pro found it on the card, zooming in on the picture previously taken and highlighting it.

My biggest criticism would be the inconsistency I have seen; it can take a few tries for a card to be properly read, sometimes it can seem like forms are being filled up with random characters. Basically, the less blurry the image (even if it is totally legible to human eyes), the more accurate the app can be. This does seem like a given, but images have to be crystal-clear in my experience with it. I do have faith that Readdle will work on accuracy. While it is not perfect now, keep in mind that is not bad; in fact, Card Scanner Pro is still a totally useful tool nonetheless.

The inconsistency is much less apparent once users get used to having to have steady hands to get a good, usable picture. Then Card Scanner Pro can impress with its ability to turn even odd fonts into plain text.

A marked improvement over simply putting a picture of every card in the camera roll along with your vacation and pet photos, Card Scanner Pro features a “Card Holder” feature that allows users to store cards in a much more organized fashion. Cards are sorted by name, with both the picture and the analyzed info saved for viewing.

Card Scanner Pro is undoubtedly a great tool to assist with saving the information on and sorting a business card. It can help save valuable time since users only have to make sure to proofread rather than entering everything manually. When a perfectly clear picture is taken, the app really does do a good job at pulling apart data from it and making it a coherent contact. Fully recommended to anybody who deals with a lot of business cards.

Apple Closes Above Exxon, Is Now Most Valuable Company In The Country

Exxon closed down $3.14 at $68.03 per share, with a market cap of $330.77 billion. Apple is now ahead by $7 billion or so.

In the beginning of 2011, Apple was $75 billion behind.

Popular iOS Game Now Available for Xbox Kinect

Save for the fact that the featured image of this editorial is a splash screen (literally) of what I’m posting about, I onclick="javascript:pageTracker._trackPageview('/outgoing/www.gamblingiq.com');" target="_blank" title="bet" href="http://www.gamblingiq.com">bet not knowing what game I’m talking about (courtesy of the shallow title) exactly made you want to click on this post. Well click away…id="more-21467">

Fruit Ninja is evidently now available on an Xbox near you. Yup, you can get the widely acclaimed, popular fruit slashing onclick="javascript:pageTracker._trackPageview('/outgoing/itunes.apple.com/us/app/fruit-ninja/id362949845?mt=8');" target="_blank" href="http://itunes.apple.com/us/app/fruit-ninja/id362949845?mt=8">game everyone was crazy about just awhile ago for your Xbox Kinect via the Xbox Live Arcade. So if you hate fruit, and want to show just how badly you despise the things from a device other than your iPhone or onclick="javascript:pageTracker._trackPageview('/outgoing/www.ipadngravy.com');" target="_blank" title="iPad" href="http://www.ipadngravy.com">iPad, you can grab the game now.

The game was recently released (a few days ago) onto the XBLA. While there’s also a free demo version of the game you can try out, the full version can be bought for 800 Microsoft Points, which equates to $10. You really can’t refuse that price, considering other Xbox games will run you a full $60 (yes, I do know that those games cannot be fairly compared to Fruit Ninja’s arcade theme and casual gameplay).

Fruit Ninja Kinect, officially speaking, is basically a full port of the iOS version of the game, with modifications made to work with Kinect’s motion detection. It’s usually the other way around with PC or console titles being ported to iOS, but it’s certainly interesting this way. You’ll use your hands to virtually slice the fruit, while your silhouette is being projected behind the fruit with ninja clothing; expected from the guys over at Halfbrick; both clever, innovative and also humorous. You’ve got the three game modes, classic, zen and multiplayer, with an additional co-op sub-mode being thrown in to the latter of the three modes. This is where you can play with another player on the same console, though be warned that you should make sure not to smack your fellow player while attempting to slice fruit!

Check out the trailer for the native game below. It’s got some clips from the game itself as well as Halfbrick’s familiar humor that they’ve included in the rest of their iOS trailers. Fruit Ninja’s iPhone trailer is also included below for comparison.

iPod touch ditched by criminal, run over by car

iPod touch survives crime, car

Longtime TiPb reader and law enforcement officer, Mike, sent us this tale of a poor iPod touch that got caught up in a sordid tale of crime, survived being run over by a car, and lived to play music about it all.

Story after the break!

[Thanks Spanishcop!]

Early this morning I was patrolling when I heard my Sergeant call out a foot-pursuit. I responded to assist, 3 male subjects had left running on foot in different directions and my Sergeant was chasing one of then. One of the other suspects circled back and jumped into a Pontiac Grand Am and left the area just as I was about to arrive.

While checking the area, I found a lighter, evidence of drugs of abuse, and an iPod touch 8 gig.

What is funny (to me) and yet amazing… One of the suspects dropped the ipod when they saw my Sergeant arriving to their location. Then the one suspect that got into the Pontiac ran over the iPod touch with the front tire.

Amazingly… As you can see in the video the iPod touch still works. I was able to power it on and off. I recorded a short video to show it. Because it is password protected by the suspect I was not able to gain access to it. But I double clicked the home button and I was able to play music on it. So it appears it is in working order aside from some cosmetic issues.

It’s a amazing that a car can run over it and still work.

Just thought I would share it.

Also I have never jail-broken my personal iphone… So I don’t know what to expect… But The suspects iPod has an apple on power on that turns into a skull. I figure that it is jail broken.

Your more than welcome to share the story.

P.S…. NOTE TO SUSPECT: if you want your iPod touch back, come to the police department to claim it, and we can have a chat… You know who I am and where to get it…. lol.

This Is The Best iPhone 5 Render We’ve Seen

style="text-align: left;">href="http://cdn.everythingicafe.com/wp-content/uploads/2011/08/iphone5-4-1.jpg">class="aligncenter size-large wp-image-23001" title="iphone5-4 (1)" src="http://cdn.everythingicafe.com/wp-content/uploads/2011/08/iphone5-4-1-1024x768.jpg" alt="" width="614" height="461" />href="http://www.macrumors.com/2011/08/10/this-could-be-what-apples-iphone-5-looks-like/">MacRumors have just done something kinda brilliant. They took those leaked href="http://www.everythingicafe.com/iphone-5-to-have-larger-screen-no-home-button-curved-back/2011/07/26/">iPhone 5 case design specs from last month, and hired a design firm to mock up the iPhone 5 based on that information. What they came up with is probably the most realistic render we’ve seen so far of what the iPhone 5 will look like.

style="text-align: left;">There are plenty of assumptions going on here — we don’t know what every opening in the case amounts to, we’re not sure about the size and shape of the screen, or if the home button will become longer like shown in these shots.

style="text-align: left;">href="http://cdn.everythingicafe.com/wp-content/uploads/2011/08/iphone5-3.jpg">class="aligncenter size-large wp-image-23002" title="iphone5-3" src="http://cdn.everythingicafe.com/wp-content/uploads/2011/08/iphone5-3-1024x768.jpg" alt="" width="614" height="461" />This might not  be exactly what the final iPhone 5 looks like, but I’m guessing it’ll be pretty close. So, what do you think? Do you like the curved back? Will you miss the ice-cream bar of the iPhone 4?

Walmart’s VUDU streaming video service goes web app for iPad

Walmart's VUDU streaming video service goes web app for iPad

Add Walmart’s VUDU streaming video service to the growing list of content companies creating HTML5 web apps for iPad to neatly step around Apple’s revenue sharing requirements.

Beginning today, iPad users can go to VUDU.com and browse through VUDU’s entertainment content library, which includes more than 20,000 blockbusters, Hollywood classics, independent films and TV episodes, then rent or purchase and watch them instantly. For one touch access to VUDU, customers can add a VUDU icon to their iPad desktops by clicking the “Add to Home Screen” button when on VUDU.com.

No word yet on whether or not it works with AirPlay, and as our commenters repeatedly — and rightly — point out, if you do “Add to Home Screen” you don’t get multitasking background support, so it’s not yet an ideal solution.

Still, Apple and Steve Jobs have repeatedly said that HTML5 is iOS’ second great development platform. Nice to see more and more companies calling them on it.

Will you do the VUDU that you do over web app for iPad?

Apple sues Motorola over XOOM Android tablet design in Europe

http://www.tipb.com/2011/07/19/eric-schmidt-claims-apple-suing-android-manufacturers-apple-innovate/

No sooner did Apple win a preliminary injunction against the Samsung Galaxy Tab 10.1 in Germany (which carries over to most of the rest of the EU), then they’ve gone and sued Motorola over the same trade dress/design infringement grounds for the XOOM tablet. (And a local German company called JAY-tech for good measure.)

It’s generally considered a more noble, Zen-like achievement to grow your own line rather than cut the line of a competitor. Apple seems to think it’s smart to do both. To innovate AND litigate, and unlike Microsoft, they don’t seem to want to make Android more expensive — they want to make it less usable.

It’s clear that Apple is determined to assert its different intellectual property rights — hardware patents, software patents, and design-related rights — against Android device makers. While Apple appears to place particular emphasis on lawsuits over tablet computers in its European design-related lawsuits, I believe the reason is that a preliminary injunction can’t be requested in Germany if the right holder has been aware of an infringement for too long. There isn’t a clear statutory limit, but German lawyers usually discourage such motions unless they are filed within one month of finding out about an infringement. It’s possible to get permanent injunctions even against older products, but for preliminary ones there must be a particular sense of urgency. It’s possible that Apple has also been aware of the Xoom for too long to file for a preliminary injunction at this stage.

Preliminary injunctions seem easy to get, settlements usually harder to negotiate. We’ll see what happens.

iPhone 4 vs. BlackBerry Bold 9900 (and Nexus S) browser battle!

You knew it was coming, right? The moment Chris got his hands on the new touch screen, front-facing QWERTY BlackBerry Bold 9900, he just couldn’t wait to put it head to head against the other best mobile browsers in the business, Apple’s iPhone 4 Safari and Google’s Android browser as instantiated on the Samsung Nexus S.

This time around, as seen in the video above the BlackBerry Bold 9900 browser kept pace with the iPhone 4 and Samsung Nexus S we pitted it against and now, BlackBerry is enjoying the richer browsing experience it should have had all along.

It’s interesting to note that all three (and HP webOS) are now using WebKit, the Apple-driven open source web rendering engine, but each have their own JavaScript engine and their own unique implementations. Most importantly, they’re all pushing each other for better, faster, more powerful web support, and that’s good for us.

Of course, the BlackBerry Bold 9900 has a much smaller screen (in order to leave room for that keyboard), but we’re sure the good folks at CrackBerry will repeat this battle with the full screen BlackBerry Torch 9850 when they get their geeky little hands on it.

Amazon Skirts Apple’s Restrictions With Awesome Kindle Cloud Reader

Apple’s view on apps has always been “if you don’t like the App Store rules, make a web app!”, and Amazon has done just that. Not willing to fork over 30% of their revenue through Apple’s control of in app purchases, they have just rolled out a web app — the href="https://read.amazon.com/">Kindle Cloud Reader.

It’s a web app that will work through Chrome or Safari, and has been optimized for Mobile Safari, making it perfect to use on the iPad.

And yes, it does support offline reading, so you can plow through the most recent Hunger Games novel while at 30,000 feet.

Caveats: it’s not on the iPhone yet, and you’re still limited to a finite number of devices, and it seems that having the iPad app and the Cloud app reading your book each counts as a device. Lame!

Amazon announces Kindle Cloud Reader web app for iPad, Mac, Windows

Amazon announces Kindle Cloud Reader

Amazon just let us know that their Kindle Cloud Reader is now live, and lets you read any of their over 950,000 Kindle books right in Safari on iPad, Mac, or Windows, or Chrome on Windows, Mac, or Linux, without needing the Kindle app or hardware.

While there’s no iPhone or iPod touch (it tells you your browser isn’t supported and you should download Safari or Chrome, though hopefully a better intercept screen is in the works), it’s a full HTML5 web app and includes offline storage. I’ve tried it out on iPad and it works quickly and cleanly. The Kindle Store is built in, so there’s no jarring transition to the Amazon.com version of the store, and all the menus and options work really well. Likewise, the text is just a legible as it is in the app, and the WhisperSync works perfectly. Hopefully it keeps up that level of performance when personal libraries get really big.

With the controversy that arose in the wake of Apple’s App Store subscription service, and the requirements to match pricing (since dropped) and remove links to external stores (still in effect), it felt like only a matter of time before Amazon would go this route. It will be interesting to see how many others follow.

Details and screen shots after the break. Anyone going to stop using the app and switch to the web app?

“We are excited to take this leap forward in our ‘Buy Once, Read Everywhere’ mission and help customers access their library instantly from anywhere,” said Dorothy Nicholls, Director, Amazon Kindle. “We have written the application from the ground up in HTML5, so that customers can also access their content offline directly from their browser. – Start reading over 950,000 Kindle books instantly within your browser
– An embedded Kindle Store optimized for your web browser makes it seamless to discover new books and start reading them instantly
– New Kindle Store for iPad is built from the ground up for iPad’s touch interface
– Your current book is automatically made available for offline use, and you can choose to save a book for reading offline at any time
– Receive automatic software updates without the need to download new software

– View all of the notes, highlights, and bookmarks that you’ve made on other Kindle apps or on Kindle

Kindle Cloud Reader is available for Safari on iPad, Safari on desktop and Chrome starting today. Kindle Cloud Reader on the iPad is optimized for the size and unique touch interface of iPad. Without even leaving the app, customers can start shopping in the Kindle Store and will find a unique and immersive shopping experience built specifically for iPad’s Safari browser.

Kindle Cloud Reader will be available on additional web browsers, including Internet Explorer, Firefox, the BlackBerry PlayBook browser, and other mobile browsers, in the coming months.

Apple’s Hardware Recycling Just Got Awesome

href="http://cdn.everythingicafe.com/wp-content/uploads/2011/08/Screen-Shot-2011-08-10-at-7.59.17-AM.jpg">class="aligncenter size-full wp-image-22994" title="Screen Shot 2011-08-10 at 7.59.17 AM" src="http://cdn.everythingicafe.com/wp-content/uploads/2011/08/Screen-Shot-2011-08-10-at-7.59.17-AM.jpg" alt="" width="459" height="455" />Apple has just quietly updatedhref="http://www.apple.com/recycling/"> their hardware recycling program, and made it worth your while to send them your old gear. In many places, recycling your old gadgets and gear can cost you money, but Apple’s program is not only free, but might give you some dosh back afterwards.

“Send us your old iPhone, iPad, Mac, or PC for reuse or recycling. If it has monetary value, we’ll apply that toward an Apple Gift Card. If not, we can recycle it responsibly for you.”

The program has been href="http://www.macrumors.com/2011/08/09/apple-expands-recycling-options-for-old-computers-and-mobile-devices/">updated to take old iPads and iPhones, which it didn’t use to,

Sure, you might not get any money for your ca 1998 PowerBook, but at least you know it’ll be dealt with responsibly.

Will Kno Finally Bring Good Textbooks To The iPad?

href="http://cdn.everythingicafe.com/wp-content/uploads/2011/08/jpg.jpeg">class="aligncenter size-full wp-image-22997" title="jpg" src="http://cdn.everythingicafe.com/wp-content/uploads/2011/08/jpg.jpeg" alt="" width="443" height="590" />

One of the potential uses for the iPad I personally was most excited for wat the idea of textbooks. Even though I’m long out of university, I remember paying a fortune for those damned things, and lugging them everywhere. There been a lot of rumor over the last couple of years about href="http://www.everythingicafe.com/tag/textbooks/">textbooks shifting to the tablet, but so far the results have been lackluster to say the least.

Hopefully that is set to change, thanks to a company called href="http://kno.com/">Kno. Business Insider has a look at href="http://www.businessinsider.com/kno-screen-shots-2011-8?op=1">their moves to digitize textbooks, and they’re doing the most important thing for many students: marking the books down to a human price:

Kno says it has 100,000 textbooks in its system and it sells books at a 30-50% discount from physical copies. It offers rentals — 180 days with the book — for 50% off the cover price.

Here’s hoping this is the first step to getting decent digital textbook content onto the iPad, and out of paper.

Facebook Messenger Hides Video Chat Capabilities

href="http://cdn.everythingicafe.com/wp-content/uploads/2011/08/image.png">class="aligncenter size-full wp-image-22988" title="image" src="http://cdn.everythingicafe.com/wp-content/uploads/2011/08/image.png" alt="" width="300" height="450" />

Yesterday href="http://www.everythingicafe.com/facebook-messenger-gets-released/2011/08/09/">saw the release of Facebook Messenger, the social networks attack on iMessages, BBM, SMS and every other text based communications tool on the planet. However, it seems there might be more to Messenger than is immediately apparent. href="http://9to5mac.com/2011/08/09/facebooks-messenger-app-hides-a-dirty-little-secret-video-chats">9to5Mac has gone nosing around inside the depths of the app, and found a whole bunch of resources pertaining to video calling.

While completely non-functional right now, it appears that this would work between iPhone and Android, and might have something to do with the recently announced Skype/Facebook deal.

So this app can send messages to Android and iPhone with push, to every other Facebook user in the world via Facebook Messages, to any other cellphone in the world with SMS, and will be able to do video chat? Looks like things just got serious!

Apple Emptying United Kingdom Stores Due to Riots

As a result of the rioting tragedy that has been taking place in London and surrounding areas over the past four days, Apple is taking precautions to protect retail store employees and inventory. Not only have many stores in the United Kingdom been temporarily closed, but all product stock, including display units, has been moved out of a number of Apple Store locations.

It is known that Apple retail locations Liverpool ONE, Meadowhall, Cabot Circus have been adhering to these precautions. However, quite a few stores have faced part of the turmoil and it has not been confirmed whether they are following the same safety measures. Entrances to the mall housing Apple Store Bullring in Birmingham were destroyed but the store had placed four savage dogs outside to threaten looters.

The flagship Regent Street store is currently closed, with products still inside the premises. Police were parked outside of the store to protect the business area, but not the Apple Store in particular.

Apple’s measures follow the abhorrent onclick="javascript:pageTracker._trackPageview('/outgoing/www.bbc.co.uk/news/uk-14449675');" target="_blank" href="http://www.bbc.co.uk/news/uk-14449675">rioting that had began taking place in London on Saturday after a 29 year-old Mark Duggan, reported to be a prominent drug dealer, was shot by police. What started out as a protest against the Metropolitan Police’s shooting of the man quickly became violent and has influenced a high amount of rioting, which has yet to seize. Ongoing heinous acts include motiveless widespread lootings and destruction.

Our hearts go out to everybody affected by the riots. We wholeheartedly hope that rioters see the errors of their ways and are swiftly brought to justice.

Samsung Galaxy Tab 10.1 Sales Banned at Apple’s Request

Things are not looking good for Samsung in the legal battle with Apple as sales of the Samsung Galaxy Tab 10.1 tablet have been banned in the European Union, with the exception of the Netherlands. Apple was granted a preliminary injunction against the tablet, putting a hold on distribution within the (huge) aforementioned area. Though there is also a lawsuit going on in the Netherlands, so Galaxy Tab 10.1 distribution may come to a temporary end there as well.

The injunction was granted due to Apple’s claims of design infringement. It was confirmed that this is indeed the case by an Apple representative. Specifically, infringement of Apple’s Community design no. 000181607-0001 (partly pictured above). In the European Union, Community designs are granted on the basis of unique design, giving its creator(s) exclusive right to the use of it in order to prevent imitations.

If the terms of the injunction are violated, Samsung could face a fine of up to $350,000 for each that is disregarded. If such infringing behavior continues, the management at Samsung could even find themselves imprisoned for a maximum of two years.

Since Apple has requested a similar fate in Australia for the Galaxy Tab 10.1, Samsung has delayed release in that country. A preliminary injunction is also possible in the United States, with a court hearing regarding it set for mid-October. Based on the trouble in the European Union, Samsung better hope they have a bit more luck on their side in the U.S. It has been blatant that Apple has a strong case, one that they could use against many modern smartphone/tablet manufacturers, it just was not as obvious how strong it would hold up in court.

Why doesn’t Samsung just call Apple its “inspirational idol” and become a little more creative so the two can put this all behind them in an amicable way?
